1. About Us

This website, power-generator.uk, is operated by Leader Pro Ltd, trading as Power Generators.

Throughout these Terms & Conditions, references to “Power Generators”, “we”, “us” and “our” mean Leader Pro Ltd trading as Power Generators.

These Terms & Conditions apply to products purchased through power-generator.uk.

By placing an order with us, you agree to these Terms & Conditions. Please read them carefully before completing your purchase.

2. Our Contract With You

When you place an order through our website, you are making an offer to purchase the goods shown in your order.

After placing an order, you will normally receive an order acknowledgement by email. This acknowledgement confirms that we have received your order but does not necessarily mean that your order has been accepted.

A contract between you and us is formed when we accept your order, normally by dispatching the goods and sending you a dispatch confirmation.

We may decline or cancel an order before acceptance where, for example:

• A product is unavailable
• We are unable to obtain payment authorisation
• An incorrect price or product description has been displayed
• We identify suspected fraudulent activity
• We are unable to deliver to the address provided
• The order breaches these Terms & Conditions

If we cancel an order after payment has been taken, we will refund the amount paid.

3. Product Information

We take reasonable care to ensure that product descriptions, specifications, photographs and other information displayed on our website are accurate.

However, manufacturers may occasionally update specifications, designs, colours or components without prior notice.

Images are provided for illustrative purposes and minor differences may exist between the product shown and the product supplied.

Where a particular specification or feature is essential to your purchase, please contact us before ordering so that we can confirm it.

4. Prices and VAT

All prices are displayed in pounds sterling (GBP).

Where applicable, VAT will be clearly shown as part of the product price or during checkout before you complete your purchase.

The total amount payable, including any applicable VAT and delivery charges, will be shown before you confirm your order.

We take reasonable care to ensure that prices displayed on the website are correct.

If we discover an obvious pricing error before accepting your order, we will contact you and give you the option to:

• Proceed at the correct price; or
• Cancel the order and receive a full refund of any amount already paid.

We are not required to supply goods at an obviously incorrect price where the pricing error should reasonably have been apparent.

5. Payment

Payment is normally required in full when an order is placed unless alternative payment terms have been agreed with us in writing.

Available payment methods will be displayed during checkout.

Payments may be processed by third-party payment providers.

We do not normally store your complete payment card information on our own systems.

Your order may be delayed or cancelled if payment is declined, reversed or cannot be authorised.

6. Availability

All products are subject to availability.

Stock information and estimated lead times are provided in good faith but cannot always be guaranteed.

If a product becomes unavailable after you place an order, we will contact you as soon as reasonably possible.

Where we cannot fulfil your order, you will be entitled to cancel and receive a full refund for the unavailable goods.

7. Delivery

Our full delivery terms are set out in our Delivery Policy, which forms part of these Terms & Conditions.

Standard delivery to eligible Mainland UK addresses is free unless otherwise stated before checkout.

Smaller products may be delivered by parcel courier, while larger generators will normally be delivered by pallet or specialist freight carrier.

Pallet deliveries are generally made to a suitable kerbside or driveway location.

Customers must inform us of known delivery restrictions before dispatch, including:

• Narrow roads
• Height or weight restrictions
• Restricted vehicle access
• Limited turning space
• Unsuitable unloading surfaces

Estimated delivery dates are provided in good faith.

If circumstances outside our reasonable control delay delivery, we will contact you where reasonably possible.

For consumer purchases, responsibility for the goods normally passes to you when you, or a person identified by you, takes physical possession of them.

8. Inspection on Delivery

Please inspect your goods as soon as reasonably possible after delivery.

If the goods or packaging show visible signs of transit damage, please photograph the damage and contact us as soon as possible.

Where reasonably possible, visible damage should also be noted on the carrier's delivery documentation.

We ask that transit damage is reported within 48 hours where reasonably possible so that we can raise a carrier claim promptly.

This request does not limit your statutory rights.

9. Consumer Cancellation Rights

If you are purchasing as a consumer online, you normally have the right to cancel your contract within 14 days of receiving the goods, subject to applicable legal exemptions.

You normally have a further 14 days after notifying us of cancellation to return the goods.

Power Generators also offers a 30-day returns policy, subject to the conditions set out in our Returns & Refunds Policy.

Nothing in our returns policy limits your statutory rights.

10. Return of Goods

Full return instructions are provided in our Returns & Refunds Policy.

For change-of-mind returns, customers may be responsible for the direct cost of returning goods.

Because many generators are large and heavy, palletised collections may incur a collection charge where the return is not due to a fault or an error by us.

Any applicable collection charge will be confirmed before collection is arranged.

Goods should be securely packaged for return.

11. Generators That Have Been Fuelled or Oiled

Petrol and diesel generators require special consideration because adding fuel or oil may affect their condition and transportation requirements.

If you may wish to return a generator, we recommend that you do not add fuel or oil or operate the machine until you are satisfied that you intend to keep it.

Where goods have been handled beyond what is reasonably necessary to determine their nature, characteristics and functioning, we may make a deduction for any reduction in value where permitted by law.

This does not affect your rights where goods are faulty, damaged, misdescribed or not of satisfactory quality.

12. Faulty Goods and Your Statutory Rights

Products supplied to consumers must comply with applicable UK consumer law, including the requirement that goods are:

• Of satisfactory quality
• Fit for purpose
• As described

If your product develops a fault, please contact us.

Depending on the circumstances, you may have legal rights to a repair, replacement, price reduction or refund.

These statutory rights apply independently of any manufacturer's warranty.

13. Manufacturer's Warranty

Many products sold by Power Generators are supplied with a manufacturer's warranty.

Warranty periods and conditions may vary between manufacturers and products.

Manufacturer warranties may exclude problems caused by matters such as:

• Incorrect fuel
• Contaminated fuel
• Incorrect oil
• Failure to maintain the product correctly
• Unauthorised modifications
• Misuse or neglect
• Accidental damage
• Failure to follow operating instructions

Where appropriate, we may assist customers in accessing the manufacturer's authorised UK service network.

A manufacturer's warranty is provided in addition to your statutory rights and does not replace them.

14. Safe Use of Generators

Generators must be installed, operated, maintained and stored in accordance with the manufacturer's instructions.

Engine-driven generators produce exhaust gases containing carbon monoxide, which is poisonous and can be fatal.

Never operate a petrol or diesel generator inside:

• A house
• Garage
• Warehouse
• Shed
• Tent
• Caravan
• Enclosed workspace
• Other enclosed or poorly ventilated area

Generators should only be operated in a suitably ventilated outdoor location in accordance with the manufacturer's safety guidance.

Where electrical connection or installation work is required, this should be carried out by a suitably competent person.

15. Installation

Unless specifically stated as part of the product or order, the purchase price does not include installation, electrical connection, commissioning, fuel supply, groundwork or site preparation.

The customer is responsible for ensuring that the generator selected is suitable for the intended application.

For larger standby and three-phase generators, we recommend that appropriate electrical and installation advice is obtained before ordering.

16. Special-Order and Bespoke Products

Some generators or associated equipment may be manufactured, modified or configured specifically to a customer's requirements.

Products that are genuinely personalised or manufactured to an individual customer's specification may not be covered by ordinary change-of-mind cancellation rights.

Where this applies, we will make this clear before accepting the order.

This does not affect your rights if goods are faulty, damaged, misdescribed or otherwise fail to comply with applicable law.

17. Business Customers

Where goods are purchased wholly or mainly for business purposes, different contractual terms and legal rights may apply.

Consumer cancellation rights do not generally apply to business-to-business transactions.

Where we agree to accept a business return that is not required by law or contract, additional terms, handling charges or collection charges may apply.

Any such terms will be confirmed before the return is accepted.

18. Our Liability to Consumers

Nothing in these Terms & Conditions excludes or limits liability where it would be unlawful to do so.

In particular, nothing excludes or limits liability for:

• Death or personal injury caused by negligence
• Fraud or fraudulent misrepresentation
• Breach of your statutory consumer rights
• Any other liability that cannot legally be excluded

If you are purchasing as a consumer, we are responsible for losses that are a foreseeable result of our breach of these terms or our failure to use reasonable care and skill.

We are not responsible for business losses suffered by consumers, including loss of profit, revenue, business opportunity or commercial interruption.

19. Business Liability

Where you purchase goods for business purposes, we will not be responsible, to the extent permitted by law, for indirect or consequential loss including:

• Loss of profit
• Loss of revenue
• Loss of business
• Loss of production
• Loss of contracts
• Loss of anticipated savings
• Business interruption

Nothing in this section excludes liability that cannot legally be excluded.

20. Events Outside Our Control

We will not be responsible for delays or failures caused by circumstances outside our reasonable control.

These may include:

• Severe weather
• Flooding
• Fire
• Transport disruption
• Carrier delays
• Industrial action
• Government restrictions
• Supplier disruption
• Power or communications failures

Where such circumstances materially affect your order, we will contact you where reasonably possible.

21. Website Use and Intellectual Property

The content of power-generator.uk, including text, branding, graphics, photographs, product information and website design, may be protected by copyright, trade mark or other intellectual property rights.

Content must not be reproduced or used commercially without permission from the relevant rights holder.

22. Personal Information

We process personal information in accordance with our Privacy Policy.

Personal information may be shared with appropriate third parties where necessary to process your order, including payment processors, delivery companies and manufacturers or service providers handling warranty claims.

23. Changes to These Terms

We may update these Terms & Conditions from time to time.

The terms applicable to your purchase will normally be those in force when you place your order.

Any updated version will be published on our website.

24. Governing Law and Jurisdiction

These Terms & Conditions are governed by the laws of England and Wales.

If you are a consumer resident elsewhere in the United Kingdom, you may also have rights under the mandatory laws applicable where you live.

Nothing in these Terms & Conditions removes any legal rights you have regarding where a consumer dispute may be brought.

For business customers, the courts of England and Wales will have exclusive jurisdiction unless otherwise agreed in writing.

25. Severability

If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply.
